To the Commissioner for Trademarks:

Application serial no. 88497638 NATIONAL YOUTH ORCHESTRA OF THE UNITED STATES OF AMERICA(Standard Characters, see http://uspto.report/TM/88497638/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

RESPONSE TO EXAMINING ATTORNEY’S INITIAL REFUSAL TO REGISTER “NATIONAL YOUTH ORCHESTRA OF THE UNITED STATES OF AMERICA” WORD MARK (SERIAL NO. 88/497,638)

Applicant The Carnegie Hall Corporation (“Applicant”) submits the following response to the Office Action, dated September 26, 2019, and requests approval of its application to register the word mark NATIONAL YOUTH ORCHESTRA OF THE UNITED STATES OF AMERICA (the “Mark”) for the following services: “[o]rganizing and conducting musical programs, namely, auditions, training and tour performances for young musicians who perform together as a symphony orchestra” (the “Application”).

In the Office Action, the Examining Attorney initially refused registration because he believed that the Mark is primarily geographically descriptive of the origin of Applicant’s services.  The Mark, however, is registrable under Section 2(f), because, as described in the Declaration of Sarah Johnson, the Mark has acquired distinctiveness among the relevant consumer population.  See TMEP § 1210.07(b) (“A term that is primarily geographically descriptive of the goods/services under § 2(e)(2) may be registered on the Principal Register if it is shown to have acquired distinctiveness under § 2(f).”); In re Del E. Webb Corp., 16 U.S.P.Q.2d 1232 (T.T.A.B. 1990) (reversing refusal to register DEL WEBB’S NEVADA CLUB mark—which contained geographically descriptive matter—because “the entire phrase is subject to the provisions of Section 2(f) of the Trademark Act”).

In light of the foregoing, Applicant respectfully requests that the Examining Attorney permit the Application to proceed to registration.
