Miscellaneous Statement
The description of goods in the application is "Cementitious materials for building purposes" in International Class 019. The products include liquid concrete that is delivered in a liquid form by ready-mix concrete trucks and placed in a liquid form as shown in the specimens. The nature of products and the form in which they are sold and delivered to customers makes it impracticable to place the mark upon the goods themselves. The attached specimens consist of a website printout and a brochure that includes photographs of concrete pouring and placing equipment. The website printout shows use of the mark and is associated with the goods and services. Because placement of the mark upon the products is impracticable, the specimen used "on documents associated with the goods" satisfies applicable requirements. 15 U.S.C. § 1127; 37 C.F.R. § 2.56(b)(1) ("document related to the goods").
