I apologize for doubling back on this one, but I just realized that the preliminary amendment changes the entity’s citizenship (from a Florida LLC to a New York LLC), which can be interpreted as a change in entity. This may be considered a correctable error under TMEP 1201.02(c) if such an entity did not exist on the application filing date (“If the party listed as the applicant did not exist on the application filing date, the application may be amended to correct the applicant’s name.”).
Can you confirm for the record the following statement: “Remcoda LLC, a Florida limited liability company, did not exist as a legal entity on the application filing date.”
