Dear Ms. Sujek,
I am the trademark examining attorney assigned to U.S. Trademark Application No. 90760531 – Terravis Energy and design. After reviewing the application, there are just a few small issues that can be fixed without the need for an Office action.
First, we require a disclaimer for the wording ENERGY, as that wording is highly descriptive of, if not generic for, the applicant’s goods and services.
Second, we require a slight amendment to the identification for “Uninterruptable Power Supplies” because the nature of the goods is unclear. In order to make this acceptable, I suggest amending this to “Uninterruptable Electric Power Supplies”. The rest of the goods/services are acceptable as-is.
Last, we require a slight amendment to the mark description, as it appears to be the case that the stylized circle to the left of the wording is a stylized power button/symbol. Thus, I suggest the following amended mark description, if accurate, with changes in bold:
The mark consists of the stylized wording “TERRAVIS ENERGY”, with “ENERGY” below “TERRAVIS.” To the left of the wording is a stylized power button with two cut outs on the top of the power button, and a smaller circle on the bottom left of the power button.
Please let me know by March 4, 2022 if the above amendments are acceptable. If they are, I can make the changes via Examiner’s Amendment and move the application towards publication. If you have any questions, please let me know.
