Please amend the ID in Class 1 as follows: “Reagents, nucleic acids, and nucleotides for scientific and research use in the fields of clinical research, drug development, agriculture and genetics research; reagent kits comprised of reagents and chemical preparations for scientific research purposes; samples of nucleotide sequence variants and modified nucleotide sequences for use in the fields of scientific research, clinical research, and scientific diagnostics research” in Class 1

 

Pharmaceutical preparations for genetically driven disorders, neurological, gastrointestinal, metabolic, immunological,  dyslipidemias musculoskeletal, oncological disorders and diseases of the retina, liver, heart, lung, bone marrow, brain, muscle, immune system, and kidney; Reagents, nucleic acids, and nucleotides for medical and veterinary purposes", in Class 5.

Dear Ms. Dubow,

 

For U.S. Trademark Application No. 90517616,  there is one small issue that can be corrected without the need for an Office Action.

 

Identification of Goods Requirement 

 

We require an amended identification of the goods and because the wording “samples of nucleotide sequence variants and modifications” is indefinite.  Further, the wording “Pharmaceutical preparations” is indefinite and must be modified to specify the disease or condition treated or prevented. 

 

The following amended Identification is suggested, if accurate, with changes in bold:

 

“Reagents, nucleic acids, and nucleotides for scientific and research use in the fields of clinical research, drug development, agriculture and genetics research; reagent kits comprised of reagents and chemical preparations for scientific research purposes; samples of nucleotide sequence variants and modified nucleotide sequences for use in the fields of scientific research, clinical research, and scientific diagnostics research” in Class 1

 

“Pharmaceutical preparations for hypercholesterolemia, macular degeneration, and diseases of the retina, liver, heart, lung, bone marrow, and kidney; Reagents, nucleic acids, and nucleotides for medical and veterinary purposes” in Class 5

 

Please let me know by close of business on Friday, Sept. 10 if you approve of my amending the identification as described.  If you agree, I can make the changes for you via Examiner’s Amendment, and the application may proceed toward registration.  If I don’t hear from you, I will issue an Office Action.
