Issue date: March 26, 2021
IDENTIFICATION OF GOODS INDEFINITE
The identification of goods is indefinite and must be clarified because the term “instruments” is overly broad. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant must indicate the specific nature of the goods. Applicant may adopt the following identification, if accurate:
Air purifying apparatus and machines. (Class 11)
An applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the scope of the goods and/or services is not permitted. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
For assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual. See TMEP §1402.04.
INFORMATION REQUIREMENT
(1) Explain whether the wording “AG” and plus symbol in the mark has any meaning or significance in the trade or industry in which applicant’s goods are manufactured or provided, any meaning or significance as applied to applicant’s goods, or if such wording is a term of art within applicant’s industry.
(2) Respond to the following questions:
Do the goods contain silver?
Is silver a component of the goods?
See 37 C.F.R. §2.61(b); TMEP §814.
Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.
