The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

DESCRIPTION OF MARK REQUIRED

 

Applicant must submit an amended description of the mark because the current one is incomplete and does not describe all the significant aspects of the mark.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  Descriptions must be accurate and identify all the literal and design elements in the mark.  See 37 C.F.R. §2.37; TMEP §§808 et seq. 

 

The following description is suggested, if accurate (suggested wording in bold): 

 

The mark consists of a design on the upper valance and lower panel portions of a gasoline pump. The upper valance design comprises of the colors blue, silver, white and black.  The first third portion of the upper valance is the color blue with a silver curve line to the right and white in the remaining of the valence.  On the right side and inside the white portion of the valance is a circular design in black with a black border and white between the spaces with the stylized letters “JS” in blue. The design on the bottom panel of the gasoline pump shows the words “JUMPSTART” inside a white border, where “JUMP” is black and “START” is blue. Above the word “JUMP” and below the word “START” are gray lines shaped as a wedge. Below the wording is blue with a gray upward curved line above the blue. The matter shown in broken lines serves to show positioning of the mark and is not claimed as a feature of the mark.
