EXAMINER’S AMENDMENT

The Office has reassigned this application to the undersigned trademark examining attorney.

In a previous Office action dated November 11, 2020, the trademark examining attorney refused registration of the applied-for mark based on Trademark Act Sections 1 and 45.  In addition, applicant was required to respond to a request for information, translation foreign wording in the mark and amend the identification of goods.

Based on applicant’s response and the amendment below, the trademark examining attorney notes that the refusal has been withdrawn and the requirements have been satisfied.  See TMEP §§713.02, 714.04. 

Application has been amended as shown below.  As agreed to by Leslie J. Lott on July 6, 2021, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

The identification of goods is amended to read as follows:  “Skin and body topical lotions, creams and oils for cosmetic use, containing cannabidiol, (CBD), which is solely derived from hemp with a delta-9 tetrahydrocannabinol (THC) concentration of not more than 0.3 percent on a dry weight basis.”  See TMEP §§1402.01, 1402.01(e).
