USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Applicant must address issues shown below.  On October 26, 2020, the examining attorney and Mr. Mark I. Koffsky, Esq. discussed the issues below.  Applicant must timely respond to these issues.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §708.05.

 

Requirement: Amendment to Mark Description

 

A “special form drawing” of a mark includes or consists of special characteristics such as elements of design or color, style(s) of lettering, and unusual symbols and forms of punctuation.  TMEP §807.04(a).  The requirements for a special form drawing are as follows:

 

(1)        Shows the mark in black on a white background, if color is not a feature of the mark.

(2)        Is of sufficient quality that will reproduce well. 

(3)        Includes in the application a description of all literal and design elements in the mark.

In this case, applicant has applied for a special form drawing; however, because the form of the drawing is improper, the background must be addressed as it is non-white. Applicant must therefore submit an amended description of the mark because the current one is incomplete and does not describe all the significant aspects of the mark.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  Descriptions must be accurate and identify all the literal and design elements in the mark.  See 37 C.F.R. §2.37; TMEP §§808 et seq. 

 

The following description is suggested, if accurate:

 

The mark consists of a white circle to the left of the term “ACE” in lowercase where the “C” is larger than the “A” and “E”. Within the white circle is a dark vertical parallelogram tilting to the right overlapping at the top with a light vertical parallelogram tilting to the left. A darker triangle-shaped shadow partially overlays the upper half of the dark vertical parallelogram. All of the foregoing appearing against a shaded background.
