USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by Robert Lukes on October 21, 2020, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

Description of mark is amended

 

The Description of the Mark is Amended as Follows:

 

The color(s) white, green and yellow is/are claimed as a feature of the mark. The mark consists of the stylized wording "REMEDI HEALTH SOLUTIONS" on the right side, adjacent to the circular-shaped design comprised of six shaded circles, with images inside of each.  The word REMEDI is in all caps.  Describing each shaded circle in a clockwise direction, the top image is a white shaded microscope within a yellow-shaded circle, the next image are white colored symbols for male and female within a green-shaded circle; the next image is a white mortar and pestle, within a yellow-shaded circle; the next image is a white hour glass within a green-shaded circle, the next is a white set of lungs within a yellow-shaded circle, the next image is a white heart with a jagged green line inside of it, within a green-shaded circle.  The six circles are all within a white circle.  The wording, REMEDI HEALTH SOLUTIONS is entirely white in color.
