EXAMINER’S AMENDMENT

Application has been amended as shown below.  As agreed to by applicant’s attorney, W. Scott Creasman, on February 16, 2021, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

IDENTIFICATION OF GOODS AMENDED

 

The identification of goods is amended to read as follows:  “Cosmetics; cosmetic preparations; non-medicated toiletry preparations; non-medicated skincare preparations; non-medicated skincare treatments, namely, cosmetic skin resurfacing treatments, cosmetic skin refinishing treatments, facial scrubs, cosmetic facial masks, cosmetics anti-aging and anti-wrinkle treatments in the nature of creams, moisturizers, toners, and serums, and facial cleaning preparations in the nature of salicylic acne cleansers not for medical purposes.”  See TMEP §§1402.01, 1402.01(e).

 

ADDITIONAL MATTERS

 

This Office action is in response to applicant’s communication filed on January 26, 2021.  Applicant’s communication is hereinafter referenced as: “Response”. 

 

The previous Office Action of September 23, 2020, and all supporting evidence attached thereto, is incorporated by reference herein. 

 

After review of the Response, the following is determined:

• Translation requirement – the proposed translation statement is accepted and will be entered into the record;
• Disclaimer requirement – the proposed disclaimer is accepted and will be entered into the record;
• Requirement for clarification of identification and classification of goods – this requirement is addressed in the amendment herein; and
• Requirements for multiple-class applications – these requirements are OBVIATED by the amendment of the identification of goods to a single class of goods.

 

Additionally, on January 28, 2021 applicant submitted a preliminary amendment to correct applicant’s state of incorporation.  The correction is accepted and will be entered into the record.
