ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

REQUEST TO DIVIDE FILED AND WAITING ON APPROVAL OF REQUEST: Applicant has filed a Request to Divide the application on October 14, 2020. Applicant has sought to divide classes 035, 039 and class 042 from the parent application. The Parent application is to proceed with class 36 ( new class added) and 37. As we have not heard back from the USPTO on the Request to divide the application and seeing that we have a response due date of October 22, 2020, we are filing this response and await to hear from the USPTO on the Request to Divide the Application. The new class 036 is added as suggested by the Examiner and is supported by the Foreign Registration certificate being attached. COLOR ISSUE: Applicant submits that although the mark is registered in its country of origin featuring a color depiction of the mark, no claim of color is made in that registration. Accordingly, Applicant respectfully requests that the drawing be accepted. PRIOR CITED MARKS AND DESCRIPTION OF GOODS/SERVICES The description of the goods/services are being amended as suggested by the Examiner and to overcome the refusal regarding the prior cited marks. Applicant submits that the description of the goods/services as amended herein will overcome the rejection of the prior cited marks.
