I am the trademark examining attorney handling the above-referenced trademark application, which is the child application to No. 88721058. In order to move the child application forward, there is an issue that could potentially be resolved by examiner’s amendment with your approval.
Mark Description
We require an amended description of the mark for completion and clarity. In this case, the wording “where there is a partial cut-out beginning at the bottom and extending upward in the leaf” is vague because this language may also be a reference to the border of the leaf. Applicant may delete this wording because it does not appear to be necessary for the mark description. The suggested description of the mark would read as follows, with suggested changes bolded:
The mark consists of the stylized word “TITAN” with a stylized leaf design extending outwardly from within the upper right portion of the letter “N” in “TITAN”
where there is a partial cut-out beginning at the bottom and extending upward in the leaf.
Please let me know if you would approve of my amending the mark description as described.
