There are two (2) issues with the application I would like to discuss with you.

 

First, I would like to discuss the applicant’s identification of goods and services in International Classes 16, 25, 28 and 35.  Because “carrying cases specially adapted to hold collectible trading cards, holders for collectible coins and paper money” in class 16 may be identified in another International Class because cases that are fitted to carry a particular item are classified with the product that they are designed to carry, e.g., carrying cases for collectible coins in class 14 and carrying cases for collectible paper money in class 16). Further, some words in the Classes 16, 25, 28 and 35 are vague. Thus, applicant must amend the identification to clarify or limit the goods/services.  Please note that classes 9, 14 and 18 are acceptable as-is.  I have provided a suggested amended wording of the identification of goods/services in International Classes 16, 25, 28 and 35 for the applicant below, and, if accurate, applicant may accept the suggested changes (suggested changes in bold, deletions in strikethroughs):

Class 28           toys and sporting goods, namely, plush toys, toy stuffed animals, play figures, golf balls, golf bags, golf club covers, footballs, toy banks, board games relating to football, playing cards, Christmas tree ornaments, balloons, jigsaw puzzles, toy and decorative wind socks, toy cars and trucks, billiard balls, dart boards, playing cards, miniature toy helmets

 

Class 35           Marketing services, namely, promoting the goods and services of others by arranging for sponsors to affiliate their goods and services with various football personalities and/or the sport of football; dissemination of advertising for others via an on-line electronic communications network

 

Please note, applicant may amend the identification to clarify or limit the goods/services, but not to broaden or expand the goods/services beyond those in the original application or as acceptably amended. Second, I would like to discuss the use of the term “LA” in your mark. Because the wording is merely geographically descriptive of the applicant’s goods/services, applicant must disclaim it.  Please note that disclaiming the word “LA” from the mark would not affect the appearance of the mark or remove it from the mark.   Please see following suggested disclaimer, and, if acceptable, please respond with your approval:

No claim is made to the exclusive right to use “LA” apart from the mark as shown.
