USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by Kevin Krull on May 12, 2020, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

IDENTIFICATION OF GOODS

 

The identification of goods is amended to read as follows:  “printed publications, namely, magazine and magazine supplements featuring computers, computing, computer software, computer hardware, computer security, data storage, cloud computing, data security, servers, online services, high technology, communications, information technology, information services, mobile devices, telecommunications, interactive entertainment, consumer electronics, consumer technology, video equipment, audio equipment, mobile applications, portable electronic devices, social media, computer accessories, apps, smartphones, smartwatches, tablets, wearables, wireless internet, networking, gadgets, streaming media, internet of things, adapters, hubs, current events, and emerging technology.”  See TMEP §§1402.01, 1402.01(e).

 

CLAIM OF ACQUIRED DISTINCTIVENESS

 

The following claim of acquired distinctiveness under Trademark Act Section 2(f) is added to the record:

 

The mark has become distinctive of the goods as evidenced by the ownership of active U.S. Registration Nos. 5073904, 4487029, 2317674 and others on the Principal Register for the same mark for sufficiently similar goods and/or services.
