I am the trademark examining attorney handling the above-referenced application. The application was recently approved for publication; however, approval of the application has been withdrawn to address the issue below. See TMEP §706.01. The trademark examining attorney apologizes for any inconvenience this may cause applicant.
The following identification in Class 9 is incongruous as written: “monitors being downloadable computer programs for use in database management, and use as a spreadsheet”.
It is unclear whether the identified goods are some type of monitor or downloadable computer program that features a monitoring function. If it is acceptable to you, I can delete this entry from the identification, since there are already identifications for “monitoring apparatus, other than for medical purposes, namely, wireless controllers to monitor and control the functioning of other electronic devices; monitors, namely, battery monitors, TV monitors” and “computer programs, downloadable, for use in database management, and use as a spreadsheet” in Class 9.
