Application has been amended as shown below.  As agreed to by Austin Padgett on July 1, 2021, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods are not permitted.  37 C.F.R. §2.71(a).

IDENTIFICATION AND CLASSIFICATION OF GOODS

The identification of goods is amended to read as follows: 

“hemp for smoking; hemp products, namely, electronic vaporizer liquid (e-liquid) derived from hemp comprised of flavorings in liquid form, other than essential oils, for use in oral vaporizers for smokers, pre-rolled hemp for smoking, and dried hemp for use in pipes and vaporizers for smoking; all of the foregoing goods containing hemp with a delta-9 tetrahydrocannabinol (THC) concentration of not more than 0.3 percent on a dry weight basis” in Class 034

OTHER MATTERS

In light of the above amendments and those in the response, the related requirements are hereby satisfied. On 04/08/20, action on this application was suspended pending the disposition of U.S. Application Serial Nos. 88446761 and 88606026.  The referenced pending application Serial No. 88446761 has abandoned and is no longer a potential bar to the registration of applicant’s mark. However, Serial No. 88606026 has not been abandoned and therefore a subsequent suspension letter will be issued in due course. A corrected suspension letter will follow. The examining attorney apologizes for the inconvenience.
