USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

Application has been amended as shown below.  The examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  

The description of the mark is amended to the following:

The mark consists of the words "NO APOLOGIES" in all caps, with the exception of the first letter "N", in a stylized white font with letters bleeding down white ink. Underneath the word "NO APOLOGIES" is the picture of a red broken heart opening up to reveal a grey skull staring at the viewer with the left eye (viewers left) of the skull mostly covered by the broken heart. The left half of the broken heart stands vertically, slightly overlapping the word "NO" and portions of the letters "A" and "P" from the word "APOLOGIES". The right half of the broken heart lays horizontally with a blue water droplet protruding from the bottom of the horizontal half of the heart. The background is black.
