I’m contacting you regarding Trademark Application Serial No. 88615714 for the mark “S2”. The application is in very good shape, and there was just one small issue that I think we can address via email.
Specifically, the applicant must provide its domicile street address, as per the new rules that went into effect on August 3, 2019. See 37 C.F.R. §§2.2(o)-(p), 2.11(a), 2.189; Requirement of U.S.-Licensed Attorney for Foreign-Domiciled Trademark Applicants & Registrants, Examination Guide 4-19, at I.A. (Rev. Sept. 2019).
The application record currently lists the applicant as a juristic entity and specifies applicant’s domicile as a post office box instead of a street address. In most cases, a post office box is not acceptable as a domicile address because it does not identify the location of applicant’s headquarters where the entity’s senior executives or officers ordinarily direct and control the entity’s activities. See 37 C.F.R. §§2.2(o)-(p), 2.189; Examination Guide 4-19, at I.A.3. Therefore, the applicant must provide its domicile street address. See 37 C.F.R. §2.189.
If you confirm the applicant’s domicile street address, I would be happy to enter the changes for you via an examiner’s amendment. If you could please reply by Friday, December 20 at 5pm Eastern Time, I would very much appreciate it.
