Good afternoon Ms. Christiansen,

 

I am the trademark examining attorney handling the trademark applications for CYCLE (Docket Nos. 21976-5000 and 21976-5001/Serial Nos. 88610508 and 88610511). I need to make a small amendment to the application in order to move it forward. I need to clarify whether the shaded background is claimed as a feature of the mark. I propose the following amendment:

 

The mark consists of a stylized soda can tab. Centered below the tab is the word "CYCLE", in which the counter of the letter "C" contains a circle. The shaded area represents transparent background area and is not claimed as a feature of the mark.

 

If this amendment is acceptable, I’ll issue an Examiner’s Amendments and conduct my final review before approving the marks for publication. Please let me know by Wednesday, Dec. 18. If you have any questions, please feel free to call or email me.
