EXAMINER’S AMENDMENT

Issue date:  October 08, 2019

USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

Application has been amended as shown below.  As agreed to by Steven J. Solomon on October 4, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

IDENTIFICATION OF GOODS

The identification of goods in Classes 018 and 025 is amended to read as follows:   

“Luggage; bags, namely, all-purpose carrying bags, travel bags, shoulder bags, handbags, tote bags, overnight bags, duffle bags, and leather bags; wallets; carriers for animals; whips; harnesses for animals; cosmetic bags sold empty; purses” in Class 018,

“Lingerie, shapewear; hosiery; garters and garter belts; panties; baby doll pajamas; stockings; breast shapers in the nature of adhesive bras; petals in the nature of nipple cover pasties; nipple cover pasties; lingerie accessories, namely, removable breast pads used in a bra; bras; bralette; slips being underclothing; teddies being underclothing; rompers; bodysuits; corsets being underclothing; bustiers; camisoles; chemisoles being underclothing; chemises; negligee; bikinis; brassiere; girdles; nightgown; nighties being underclothing; leotards; socks; tee shirts; sweatshirts; swimwear; swimwear accessories, namely, swim caps, cover-ups, beach cover ups; shoulder wraps for clothing; shawls; robes; sarongs; cloaks; shorts; visors being headwear and sunhats; headwear; shoes, namely, sandals; leather and imitation leather belts; leather harnesses worn by people as clothing” in Class 025.
