USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  As agreed to by Lindsey E. Utrata on November 22, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

AMENDMENT OF IDENTIFICATION OF GOODS

 

The identification of goods is amended to read as follows:

 

Class 3: Non-medicated soaps; cleaning preparations; hair care preparations; hair colorants; hair dyes; hair lotions; hair waving preparations; shampoos; hair conditioners; hair sprays; hair washing powder; hair dressings for women; hair dressings for men; hair lacquers; hair mousses; hair glazes; hair gels; hair moisturizers in the nature of conditioners; hair liquids in the nature of non-medicated liquid moisturizing treatment preparations for hair for cosmetic purposes; hair oils; hair tonic; hair creams; non-medicated bath and shower preparations; antiperspirants and deodorants for personal use

AMENDED MARK DESCRIPTION

 

The following description of the mark replaces the current description of record:

 

            The mark consists of a gray tree design with the tree’s roots exposed. Below and to the right of the tree are three curved lines in gray, dark blue, and blue. The shaded background is for contrast purposes only and is not a feature of the mark.

COLOR CLAIMED

 

The following color claim is added to the record:

 

            The colors blue, dark blue, and gray are claimed as a feature of the mark.
