Dear Mr. Mehta

 

I am the trademark examining attorney at the U.S. Patent and Trademark Office to whom this application has been assigned. There  are minor issues that we can resolve by examiner's amendment, based on your reply to this email or a phone call.

 

First, the applicant must disclaim the  generic wording "TINY ."  This term tells consumers that the goods include tiny rice.  The grains of rice are realistic, not stylized. The statement that will be printed on your registration certificate should read as follows:

 

-          No claim is made to the exclusive right to use "TINY" and the design of individual grains of rice apart from the mark as shown.

 

Second, please authorize me to change the description of your mark to the following, if accurate:

 

-          The mark consists of the stylized word "TINY", with the letters "T","I", and "N" spelled in block font with white rice grains. The "I" letter has a green bay leaf as its dot on top. The "Y" letter is made with black clove, green cardamon, and a brown cinnamon stick. The entire design is set against a black background.

 

I would be happy to enter  these amendments for you, and move the application forward. Please tell me how you want to proceed or if you have questions.
