The request to delete the Section 1(b) intent-so-use basis for registration filed on September 2, 2020, is denied because applicant has no other basis for registration. 15 U.S.C. §1051(b).
Applicant must continue to file requests for extension of time to file a statement of use (extension requests), or a statement of use, as they become due, in order to avoid abandonment of the application.
Applicant may substitute a Section 44(e) basis for registration by filing a petition to the Director requesting a substitution of basis. 37 C.F.R. §2.146. The petition must be accompanied by a $100 electronic filing fee. 37 C.F.R. §2.6. A copy of the foreign registration certificate must accompany the petition.
