Good morning Deborah,
Thank you for taking the time to speak with me yesterday and for your valuable insights. As per your recommendations, I am revising our description to read:
“A chromogenic diagnostic system for bacterial and mycological culture, namely agar plates containing single and multiple combinations of known and proprietary chromogenic agars for bacteriological and mycological culture to be used in the clinical laboratory diagnosis of infections of skin, ears, tissues, organs, body cavities, body fluids including urine, exudates, transudates, and milk of humans and animals contained in single and multi-compartment circular and rectangular plastic petri dishes.”
With regard to our choice of “Spectrum” to distinguish our brand of chromogenic products:
Spectrum is a term used in physics to describe the array of colors produced by light when it is refracted through a prism. It is often used in the English language to refer to products or things that appear in a variety of colors. As such, when organisms are grown (cultured) on chromogenic agar they produce a variety of colored colonies each unique to that organism facilitating interpretation and aiding in diagnosis. Thus, we chose the term “Spectrum” to reflect the multi-colored attributes of our diagnostic system. (See representative example)
As I further understand, revision of our description if approved negates the need for us to file a formal response to the office action dated November 22, 2019. Please acknowledge this understanding to be sure I have it right. Thanks again for taking the time to speak with me yesterday. I look forward to your positive response.
