Current identification: Clothing, namely, t-shirts, baseball caps and hats; all of the foregoing being promoted, distributed, and sold through channels customary to the field of sports and collegiate athletics

The mark is in use in commerce on or in connection with all of the goods/services, or to indicate membership in the collective organization listed in the application or Notice of Allowance or as subsequently modified for this specific class.

The mark was first used by the applicant, or the applicant's related company, licensee, or predecessor in interest at least as early as 08/00/2005, and first used in commerce at least as early as 08/00/2005, and is now in use in such commerce. The applicant is submitting one specimen for the class showing the mark as used in commerce on or in connection with any item in the class, consisting of a(n) Pursuant to TMEP 904.03(a), the submitted photos show the mark as it appears on the label (inside back neck) of the goods. Pursuant to TMEP 904.03(i), the submitted web pages constitute a "display associated with the goods" as they (a) contain pictures or textual descriptions of the identified goods; (b) show the mark in association with the goods; and (c) provide a means for ordering the goods. The submitted web pages also contain the URLs for the web pages of the specimens and the date the pages were accessed/ printed, in compliance with TMEP 904.03(i).
