Regarding the Office Action issued in this application, my client has informed me that the software is delivered in both recorded and downloadable forms – so we suggest amending the ID to read:

 

Class 9:  Computer hardware; computer hardware, namely, hyper-converged appliance (HCA); computer hardware and recorded and downloadable software systems for data management, data storage, networking and virtualization.

 

We do not wish to add Class 42.

 

If this amendment is acceptable, may we resolve the Office Action via Examiner’s Amendment? Thank you.
