Pursuant to TMEP §707.03, applicant is advised of the following status of the application. Prior to issuance of this examiner’s amendment, the following issues were outstanding with this application:
1. Section 2(d) Refusal – Likelihood of Confusion
2. Prior Pending Applications Advisory
3. Identification of Services Amendments Required
In light of applicant’s response dated January 13, 2020 and the amendments detailed below, the examining attorney has determined the following:
1. The Section 2(d) Refusal is withdrawn.
2. The Prior Pending Application Advisory is withdrawn.
3. The Requirement to Amend the Identification of Services is satisfied.
Application has been amended as shown below. As agreed to by Mark Francis on January 31, 2020, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the services are not permitted. 37 C.F.R. §2.71(a).
Mark Description and Color Claim
The colors blue is claimed as a feature of the mark.
The mark consists of the wording “STRATUS” in an upper-case font. The “A” is formed by the design of a blue angle with a blue arc underneath, forming the impression of a raindrop that is separated in the middle. The white in the mark represents background or transparent areas and is not claimed as a feature of the mark.
