Good evening. I have received and reviewed the response to the Office action in SN 88530235, GRID. Thank you for providing a copy of the foreign registration wherein the mark matches the mark drawing in the U.S. application.
The amendments to the identification are sufficient for me to withdraw the Section 2(d) refusals and to determine that no refusals will issue based on the prior-filed applications. However, the wording “and/or” in the identification of services is indefinite and should be replaced with the word “and”. So the identification would read:
Class 42: Design and development of computer software; providing temporary use of on-line non-downloadable computer software for building and delivering visualizations, narrative and interaction on top of data, in particular from spreadsheets
Additionally, the mark description appears to be inaccurate because the design in the mark drawing looks to be shades of purple and blue, not simply shades of blue. I propose the following mark description, if accurate:
The mark consists of geometric figures consisting of a curved band that is purple on the left and gradually changes to blue on the right over a purple oval-like shape, with the stylized wording “GRID” in purple to the right side.
If applicant approves of the above amendments, I can issue an Examiner’s Amendment making the changes, and then I should be able to approve the mark for publication. I would appreciate a response as soon as possible, but not later than the close of business on Friday, February 14, 2020.
