EXAMINER’S AMENDMENT
Issue date: October 08, 2019
USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.
Application has been amended as shown below. The trademark examining attorney is amending the application as follows. No prior approval or authorization from applicant or applicant’s attorney is required. TMEP §707.02.
In the initial filing, Applicant stated that the name shown in the mark does not identify a particular living individual. 15 U.S.C. § 1052(c); TMEP § 813.01(b). Since the mark is such that no living individual inquiry would have been made, the statement will remain of record for informational purposes only and will not be printed on any registration certificate that may ultimately issue. TMEP §§ 813.01(b), 1206.03, 1206.05.
The initial filing included a statement that “Sakaly” has no meaning in a foreign language. Given the construction and appearance of the term, the statement is not necessary. Therefore, the information will remain of record for informational purposes only and will not be printed on any registration certificate that may ultimately issue. TMEP § 809.03.
