EXPLANATION OF FILING
Applicant respectfully requests that the form of its name be updated in the U.S. Patent and Trademark Office (USPTO) records from "Simplify Medical Pty, Ltd." to "Simplify Medical Pty Limited." When the application was originally filed, Applicant identified itself as "Simplify Medical Pty, Ltd.," choosing to use the abbreviation "Ltd." rather than using the complete term "Limited." Since the filing of this application, Applicant has learned that the USPTO records identifying it as "Simplify Medical Pty, Ltd." rather than "Simplify Medical Pty Limited"may negative impact its ability to claim priority to the application for trademark applications outside of the U.S. as some countries strictly require that the identification of company in a certification of incorporation exactly match the name of the base or priority application. In this case, Applicant's certification of incorporation identifies itself as "Simplify Medical Pty Limited" but Applicant filed this application in the name of "Simplify Medical Pty, Ltd.," where it used the abbreviation "Ltd." rather than spelling out the word as "Limited." At all times, Applicant has been the same entity so this request that the form of its name be updated to "Simplify Medical Pty Limited" is not a request to change the identity of an applicant. Applicant respectfully submits that this a correctable issue, similar to minor clerical errors that are correctable under TMEP 1201.02(c)(3). Accordingly, Applicant requests that the USPTO records be updated to reflect its name as "Simplify Medical Pty Limited." Please contact the undersigned attorney if you have any questions.
