NONFINAL OFFICE ACTION

 

The USPTO must receive applicant’s response to this letter within six months of the issue date below or the application will be abandoned.  Respond using the Trademark Electronic Application System (TEAS).  A link to the appropriate TEAS response form appears at the end of this Office action. 

 

Issue date:  April 12, 2020

 

This Office action is supplemental to and supersedes any previous Office action issued in connection with this application.  The assigned trademark examining attorney inadvertently omitted a requirement relevant to the mark in the subject application.  See TMEP §§706, 711.02.  Specifically, the terms “metal garages” must be amended to indicate that the garages are prefabricated.

 

The trademark examining attorney apologizes for any inconvenience caused by the delay in raising this issue. 

 

Applicant must address all issue(s) raised in this Office action. 

 

The following refusals will be reconsidered pending the submission of an acceptable identification of goods:  Likelihood of Confusion.  See TMEP §713.02.

 

The following is a SUMMARY OF ISSUES that applicant must address:

 

              NEW ISSUE:  Identification of Goods

           

Applicant must respond to all issues raised in this Office action, within six (6) months of the date of issuance of this Office action.  37 C.F.R. §2.62(a); see TMEP §711.02.  If applicant does not respond within this time limit, the application will be abandoned.  37 C.F.R. §2.65(a).

 

Identification of Goods

The identification of goods is indefinite and must be clarified because the applicant must indicate that the metal garages are prefabricated and indicate that the sheds are storage sheds.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant must amend the identification to specify the common commercial or generic name of the goods.  See TMEP §1402.01.  If the goods have no common commercial or generic name, applicant must describe the product, its main purpose, and its intended uses.  See id.

 

Applicant may adopt the following wording, if accurate:  Prefabricated metal garages and metal storage sheds, in Class 6.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
