Application has been amended as shown below.  As agreed to by Diane Mason on March 2, 2020, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

The identification of services is amended to read as follows:  “Providing on-line training materials in the field of sales, installation, use and maintenance of mobile devices, computers, computer peripherals, monitors, signage, displays and memory devices; education, namely, providing classes, workshops, seminars, and training in the field of sales, installation, use and maintenance of mobile devices, computers, computer peripherals, monitors, signage, displays and memory devices; providing a web site with non-downloadable publications in the nature of data sheets, periodicals, brochures, articles, study and teaching guides, electronic reference books, newsletters, manuals, reviews, and booklets in the field of sales, installation, use and maintenance of mobile devices, computers, computer peripherals, monitors, signage, displays and memory devices” in Class 41.  See TMEP §§1402.01, 1402.01(e).

 

The identification of goods and services in Classes 9 and 35 is acceptable as amended.

 

The refusal under Section 2(d) is withdrawn. The requirement for attorney bar information and attestation has been satisfied.
