ARGUMENT(S)

Applicant submits this response to the office action dated September 23, 2019.

 

The Office Action has provisionally refused registration based on the senior application to register COMMSCOPE CONNECTIVITY (App. No. 87/726,177), owned by CommScope Connectivity LLC.  However, CommScope Connectivity LLC is a wholly owned subsidiary of CommScope Technologies LLC.  CommScope Technologies LLC is a wholly owned subsidiary of CommScope, Inc. of North Carolina, the applicant in this case.  Accordingly, the senior applicant and the present applicant together are a single source of the respective goods such that there would be no likelihood of confusion.  Accordingly, applicant respectfully requests that the Section 2(d) refusal be withdrawn.

 

Additionally, applicant has amended the description of goods essentially as guided by the office action.  Two exceptions are noted here.  In class 9, applicant submits that the terms “cable termination unit” are the appropriate and common name in the industry.  Attached is a sales sheet that illustrates and describes an example of one of these units.  And second, applicant submits that the terms “apparatus for monitoring, measuring, testing and controlling electrical signals” is an accurate description.  This device is also called “RET Master” by the applicant, and the sales sheet is attached to illustrate what it is.  Applicant understands that the Trademark Office dictionary might not be aware of these products, but the industry and product customers are aware.  Accordingly, applicant now submits that the application is now in condition for allowance.  Favorable action is requested hereon.

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Applicant submits this response to the office action dated September 23, 2019.

 

The Office Action has provisionally refused registration based on the senior application to register COMMSCOPE CONNECTIVITY (App. No. 87/726,177), owned by CommScope Connectivity LLC.  However, CommScope Connectivity LLC is a wholly owned subsidiary of CommScope Technologies LLC.  CommScope Technologies LLC is a wholly owned subsidiary of CommScope, Inc. of North Carolina, the applicant in this case.  Accordingly, the senior applicant and the present applicant together are a single source of the respective goods such that there would be no likelihood of confusion.  Accordingly, applicant respectfully requests that the Section 2(d) refusal be withdrawn.

 

Additionally, applicant has amended the description of goods essentially as guided by the office action.  Two exceptions are noted here.  In class 9, applicant submits that the terms “cable termination unit” are the appropriate and common name in the industry.  Attached is a sales sheet that illustrates and describes an example of one of these units.  And second, applicant submits that the terms “apparatus for monitoring, measuring, testing and controlling electrical signals” is an accurate description.  This device is also called “RET Master” by the applicant, and the sales sheet is attached to illustrate what it is.  Applicant understands that the Trademark Office dictionary might not be aware of these products, but the industry and product customers are aware.  Accordingly, applicant now submits that the application is now in condition for allowance.  Favorable action is requested hereon.
