Applicant hereby responds to the Non-Final Office Action issued on July 16, 2019.
The Examining Attorney has refused registration of the applied-for mark OCTANE (“Applicant’s Mark”), asserting a likelihood of confusion with the mark OCTANE ATHLETICS, cited in U.S. Registration No. 4530034 (the “Cited Mark”) and owned by David Jimenez (“Registrant”).
Applicant submits that Registrant appears to have discontinued use of the Cited Mark for the goods identified in Class 28, namely “baseball and softball gloves.” Therefore, Applicant respectfully requests that the Examining Attorney suspend action on Applicant’s Mark pending Registrant’s submission of its Section 8 declaration of use. |
