Dear Ms. Labutta,
I am the assigned trademark examining attorney for the above-referenced application. There are some issues I believe we can resolve via email, specifically:
1) Clarification of Mark Description and Color Claim: It is not clear if the black rectangle around the mark represents background or is a claimed feature of the mark. Applicant may adopt the following suggested amendment, if accurate:
- The mark consists of the word GRAVITY in white letters; the color black represents background and is not claimed as a feature of the mark.
2) US Counsel Information
Per the new U.S. Counsel rules, all U.S. attorneys must now provide their bar information and an attestation that they are an attorney in good standing. This applies to foreign and domestic applicants represented by U.S. counsel.
Accordingly, I would like you to confirm that you agree to the following statement, which I will enter into the record: “I attest that I am an attorney who is an active member in good standing of the bar of the highest court of a U.S. state (including the District of Columbia and any U.S. Commonwealth or territory).”
I would also like you to provide the following in your responsive email:
- State of bar membership
- Bar number, if applicable in your state (this will not be made public record)
- Year of bar admission
If the changes discussed above are acceptable, please provide the requested information, confirm that you agree to the attestation statement, and I will issue an examiner's amendment accordingly.
Please note for your other applications that the TEAS Revocation, Appointment, and/or Change of Address of Attorney form permits an attorney to update address information and add bar information for a batch of applications or registrations. The signature of the applicant is not required if the attorney is not making changes to the representation and merely updating information in the record.
