INTRODUCTION

 

Based on information and/or documentation in applicant’s response, the trademark examining attorney now issues the following new requirement:

  • NEW REQUIREMENT – DRAWING – COLOR CLAIM & DESCRIPTION INCOMPLETE – DOES NOT REFERENCE ALL COLORS

 

See TMEP §§706, 711.02. 

 

In a previous Office action dated August 9, 2019, the trademark examining attorney required the following:

  • REQUIREMENT – DRAWING – MARK IMAGE UNCLEAR
  • REQUIRMENT – ATTORNEY BAR INFORMATION & ATTESTATION

 

Based on applicant’s response, the trademark examining attorney notes that the following requirements have been satisfied:

  • SATISFIED – REQUIREMENT – DRAWING – MARK IMAGE UNCLEAR
  • SATISFIED – REQUIRMENT – ATTORNEY BAR INFORMATION & ATTESTATION

The following is a SUMMARY OF ISSUES that applicant must address:

  • NEW REQUIREMENT – DRAWING –DESCRIPTION INCOMPLETE – DOES NOT REFERENCE ALL ELEMENTS & COLORS

 

Applicant must respond to all issues raised in this Office action within six (6) months of the date of issuance of this Office action.  37 C.F.R. §2.62(a); see TMEP §711.02.  If applicant does not respond within this time limit, the application will be abandoned.  37 C.F.R. §2.65(a).

 

SEARCH OF USPTO DATABASE OF MARKS

 

The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

NEW REQUIREMENT – DRAWING –DESCRIPTION INCOMPLETE – DOES NOT REFERENCE ALL ELEMENTS & COLORS

 

Applicant must provide an amended description of the mark that includes all the literal and design elements and colors shown in the mark.  Specifically, the following elements and colors have been omitted:  description of where light blue is in the mark; the protruding edge on the right and left side of the single line circle.

 

A complete description must identify all the literal and design elements in the mark and specify where the colors appear in those elements.  See 37 C.F.R. §§2.37, 2.52(b)(1); TMEP §§807.07(a) et seq. 

 

The following description is suggested, if accurate:

 

The mark consists of a stylized circular design where the middle of the circular design is a shaded blue circle, surrounding the shaded circle center is another circular design of light blue shading where two sides protrude further out of the center, surrounding the shaded center area is an area of black color, on the outside of the circular design is a blue single line outline of a circle where on the right and left sides of the circle part of the circle protrudes out to a point.  To the right of the circular design is the wording “SEARCH” in grey text.  All of the aforementioned is on a black background.
