The USPTO must receive applicant’s response to this letter within six months of the issue date below or the application will be abandoned.  Respond using the Trademark Electronic Application System (TEAS) and/or Electronic System for Trademark Trials and Appeals (ESTTA).  A link to the appropriate TEAS response form and/or to ESTTA for an appeal appears at the end of this Office action.

INTRODUCTION

 

This Office action is in response to applicant’s communication filed on February 11, 2020.

 

In a previous Office action(s) dated August 23, 2019, the trademark examining attorney refused registration of the applied-for mark based on the following:  failure to function as a trademark.  In addition, applicant was required to satisfy the following requirement(s):  provide an amended drawing.

 

The following refusal(s) have also been obviated:  failure to function refusal.  See TMEP §§713.02, 714.04. 

 

Further, the trademark examining attorney maintains and now makes FINAL the refusal(s) and/or requirement(s) in the summary of issues below.  See 37 C.F.R. §2.63(b); TMEP §714.04.

 

SUMMARY OF ISSUES MADE FINAL that applicant must address:

 

  • New Drawing Required

 

DRAWING OF THE MARK

 

The amended drawing is not acceptable because it continues to show elements that are not claimed as a feature of the mark.  See TMEP §§807.02 and 807.04.  Specifically, only the color purple is claimed as the mark, not the shape of the directional control button or the circle contained within it.  Therefore, applicant must submit a new drawing showing only the color purple as used on the goods with the outline of the directional control button within the remote displayed in dashed or dotted out lines and the circle deleted.  All elements not claimed as part of the mark must be presented as dotted or dashed lines in the drawing of the mark.

 

Therefore, applicant must submit a new drawing showing a clear depiction of the mark.  All lines must be clean, sharp and solid, and not fine or crowded.  37 C.F.R. §§2.53(c), 2.54(e); TMEP §§807.05(c), 807.06(a).  Additionally, the USPTO will not accept a new drawing in which there are amendments or changes that would materially alter the applied-for mark.  37 C.F.R. §2.72; see TMEP §§807.13 et seq., 807.14 et seq.
