The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUMMARY OF ISSUES:
SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE
“Whether consumers could guess what the product [or service] is from consideration of the mark alone is not the test.” In re Am. Greetings Corp., 226 USPQ 365, 366 (TTAB 1985).
Here, the applied for mark is PROMEDIO MOVIL DE 40 for “Conducting workshops and seminars in the field of investments; Organization of seminars” in Class 41.
Applicant has provided a translation that this wording means “40 moving average.”
Applicant’s mark is in Spanish which is a common, modern language in the United States. In re Aquamar, Inc., 115 USPQ2d 1122 (TTAB 2015) (Spanish).
The doctrine is applied when “the ordinary American purchaser” would “stop and translate” the foreign term into its English equivalent. Palm Bay, 396 F.3d at 1377, 73 USPQ2d at 1696 (quoting In re Pan Tex Hotel Corp., 190 USPQ 109, 110 (TTAB 1976)); TMEP §1209.03(g). The ordinary American purchaser includes those proficient in the foreign language. In re Spirits Int’l, N.V., 563 F.3d 1347, 1352, 90 USPQ2d 1489, 1492 (Fed. Cir. 2009); see In re Highlights for Children, Inc., 118 USPQ2d at 1271.
In this case, the ordinary American purchaser would likely stop and translate the mark because the Spanish language is a common, modern language spoken by an appreciable number of consumers in the United States.
Furthermore, the attached evidence from www.investopedia.com shows that the wording MOVING AVERAGE is defined as “a widely used indicator in technical analysis that helps smooth out price action by filtering out the “noise” from random short-term price fluctuations. It is a trend-following, or lagging, indicator because it is based on past prices.” The Investopedia evidence continues to explain that moving averages are generally shown as a “moving average” over a specified amount of days or weeks. Accordingly, the attached evidence from CNBC.com and stockcharts.com shows that the “40-week moving average” is one of the most popular durations in which to evaluate the moving average of stock price.
Accordingly, the mark PROMEDIO MOVIL DE 40 is merely descriptive of the subject matter of applicant’s investment workshops and seminars. Thus, the mark is refused under Trademark Act Section 2(e)(1).
REQUEST FOR ADDITIONAL INFORMATION
(1) Fact sheets, instruction manuals, brochures, advertisements and pertinent screenshots of applicant’s website as it relates to the goods and/or services in the application, including any materials using the terms in the applied-for mark. Merely stating that information about the goods and/or services is available on applicant’s website is insufficient to make the information of record.;
(2) If these materials are unavailable, applicant should submit similar documentation for goods and services of the same type, explaining how its own product or services will differ. If the goods and/or services feature new technology and information regarding competing goods and/or services is not available, applicant must provide a detailed factual description of the goods and/or services. Factual information about the goods must make clear how they operate, salient features, and prospective customers and channels of trade. For services, the factual information must make clear what the services are and how they are rendered, salient features, and prospective customers and channels of trade. Conclusory statements will not satisfy this requirement.; and
(3) Applicant must respond to the following questions: Do applicant’s goods contain or applicant services include seminars or workshops specifically covering the 40 week and/or the 40 day moving average? Do applicant’s competitors use “40 week moving average” to advertise similar services? Who is the typical consumer of applicant’s services?

Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.
