Response to Office Action

To the Commissioner for Trademarks:

Application serial no. 88378542 PATAGONIA PROVISIONS(Standard Characters, see http://uspto.report/TM/88378542/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Office Action refused registration of the Application in part based upon likelihood of confusion under Section 2(d) of the Trademark Act with U.S. Registration No. 4,226,102 for PATAGONIA owned by Anheuser-Busch, LLC.  Applicant hereby requests suspension of the Application pursuant to TMEP Section 716.02(d) because a court proceeding is pending before the United States District Court for the Central District of California, Western Division – Los Angeles, Case No. 2:19-cv-02702-VAP (JEMx), involving claims and issues that are relevant to this Application, namely whether the registration cited against the Application is valid, and the registrability of Applicant’s mark.  Applicant hereby submits a copy of the amended pleading.  The Fifth, Sixth and Seventh Claims (pages 31-35) of the Amended Complaint seek cancellation of the cited Registration No. 4,226,102.  Applicant hereby respectfully traverses the remaining objections in the Office Action.  Consequently, the Application should be suspended pursuant to TMEP 716.02(d).
