DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found one prior pending application that may bar registration. See the attached application. This application will be suspended following this Examiner’s Amendment. TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Ian Saffer on June 18, 2019, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and services may clarify or limit the goods and services, but may not add to or broaden the scope of the goods and services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

IDENTIFICATION OF GOODS AND SERVICES AMENDED

 

The identification of goods and services is amended to read as follows:

 

Class 9:           Digital video recorders; electronic apparatus for controlling access to pay-television services; television receivers; satellite receivers; set-top boxes; downloadable computer software for processing, transmitting, receiving, compressing, organizing, manipulating, streaming, playing, reviewing, storing, filtering, and reproducing audio, video, images, graphics, text, and multimedia data; downloadable computer software for transmitting digital signals, data, and electronic messages via wired and wireless networks; remote controls for home and mobile electronic devices, namely, remote controls for televisions, radios, stereos and mp3 players; computer hardware for streaming audio, video, image and data information to a variety of network devices, namely, personal computers, mobile phones, personal digital assistants (pda), audio decoders, and video decoders; electronic devices, namely, mobile phones, smartphones, tablet computers, digital media streaming devices, and computers; telecommunications equipment, namely, computer network and data communications equipment in the nature of computer network hubs and wireless and cellular data transmitters for the Internet of Things (IoT) and transmitting data to and from smart devices, modems, point-to-point-communications equipment in the nature of wireless and cellular modules and terminals and computer network hubs for transmitting data to and from smart devices for the Internet of Things (IoT)

 

Class 38:         Broadcasting, webcasting, streaming, and transmission of audio, video, subscription television, and video-on-demand content via the internet and electronic communications networks; television broadcasting to mobile devices, namely, broadcasting of television programs to mobile phones, smartphones, laptops, and tablet computers; telecommunication services, namely, transmission of voice, data, images, graphics, audio, video, and multimedia by means of wired and wireless networks; providing an online forum for users for sharing and transmission of information related to ratings, reviews, recommendations, promotional information, and scheduling information for movies, series, television programs, webcasts, video-on-demand content, events, and activities in the field of entertainment; Internet of Things (IoT) telecommunications services, namely, wireless electronic transmission of data and information

 

Class 41:         Provision of non-downloadable movies and television programs via a video-on-demand service; entertainment services in the nature of providing non-downloadable multi-media entertainment content via the internet and electronic communications networks, namely, providing non-downloadable movies, television series, and television programs, and video clips in the fields of comedy, drama, action, adventure, sports, musicals, current events, entertainment news, documentaries, and animation via the internet

 

Class 42:         Providing temporary use of online non-downloadable software for uploading, downloading, storing, streaming, and viewing movies, television series, television programs, and music; software as a service (SaaS) services featuring computer software to manage, connect, and operate internet of things (IoT) electronic devices
