STRICT DEADLINE TO RESPOND TO THIS LETTER

TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.  A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the USPTO’s database of registered and pending marks for the English wording in the applied-for mark and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).  However, when applicant provides a response to the requests for information herein, an additional search may be conducted for the English meaning of any non-English wording and/or transliterated term provided by applicant.  See TMEP §§704.02, 809, 1207.01(b)(vi).

I.                 AMENDMENT REQUIRED – DESCRIPTION OF THE MARK

 

Applicant must submit an amended description of the mark because the current one uses broad, vague language that does not accurately describe the mark.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  Descriptions must be accurate and identify all the literal and design elements in the mark.  See 37 C.F.R. §2.37; TMEP §808.02.  The description is vague in this case because it does not describe the “design”. 

 

The following description is suggested, if accurate:  The mark consists of the stylized word “CODE”, to the left of a design comprising a curved linear shape and a loop shape.

 

 

II.               INFORMATION REQUIRED – SIGNIFICANCE OF THE MARK

 

To permit proper examination of the application, applicant must provide the following information:

 

(1)    Is the “design” in the mark an alphabetical character in any language, English or otherwise, and if so which language?

 

(2)    Does the “design” in the mark include or incorporate any alphabetical characters in any language, English or otherwise, and if so which language?

 

(3)    Explain whether the “design” in the mark has any meaning or significance in the industry in which the goods are manufactured/provided, any meaning or significance as applied to applicant’s goods or if such wording is a term of art within applicant’s industry. 

 

(4)    Does the “design” in the mark comprise or constitute foreign wording, and if so, what wording?

 

(5)    If the mark contains any foreign wording, submit an English translation of that wording and a transliteration (the phonetic spelling of the pronunciation, in Latin characters) of any non-Latin characters in a mark.  If the wording does not have meaning in a foreign language, applicant should so specify.   

 

The format for an English translation and transliteration: The English translation of “{specify wording}” is “{specify meaning in English}”.  The non-Latin characters in the mark transliterate to “{specify transliteration}” and this means “{specify meaning in English}” in English. 

 

The format for when there is no English translation or meaning of the transliteration: The wording “{specify wording}” has no meaning in a foreign language.  The non-Latin characters in the mark transliterate to “{specify transliteration}” and this has no meaning in a foreign language.

 

(6)    Respond to the following questions:

 

What is the “design” in the mark?  Please describe.

Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.
