Summary of Issues that Applicant Must Address:
REFUSAL UNDER SECTION 2(e)(1) – MARK IS MERELY DESCRIPTIVE
The applied-for mark is “REAPER” in standard character form for “pepper spray” in International Class 13.
“Whether consumers could guess what the product [or service] is from consideration of the mark alone is not the test.” In re Am. Greetings Corp., 226 USPQ 365, 366 (TTAB 1985).
As listed in the application, applicant’s identification of goods is broad enough to include pepper spray comprised of reaper peppers. The Guinness World Records states “[t]he hottest chilli pepper is the Carolina Reaper.” Taken together, when used in connection with the identification of goods, the mark “REAPER” immediately tells consumers that applicant’s pepper spray features reaper peppers.
Descriptiveness is considered in relation to the relevant goods. DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1254, 103 USPQ2d 1753, 1757 (Fed. Cir. 2012). “That a term may have other meanings in different contexts is not controlling.” In re Franklin Cnty. Historical Soc’y, 104 USPQ2d 1085, 1087 (TTAB 2012) (citing In re Bright-Crest, Ltd., 204 USPQ 591, 593 (TTAB 1979)); TMEP §1209.03(e). “It is well settled that so long as any one of the meanings of a term is descriptive, the term may be considered to be merely descriptive.” In re Mueller Sports Med., Inc., 126 USPQ2d 1584, 1590 (TTAB 2018) (quoting In re Chopper Indus., 222 USPQ 258, 259 (TTAB 1984)). Thus, the fact that the wording could refer to a machine to cut and gather crops, or the “Grim Reaper,” does not take away from the descriptiveness of the term in relation to the applied-for pepper spray goods. See the attached dictionary evidence.
This finding of descriptiveness is also supported by third party use in the pepper and pepper spray industries. The examining attorney has attached sample websites from the Internet that show that third parties use the term “reaper” to name a characteristic, feature, or ingredient of the goods in applicant’s identification of goods. This includes the following sample attachments:
Given the analysis above, the mark is merely descriptive of the goods and is refused registration under Section 2(e)(1) of the Trademark Act.
SUPPLEMENTAL REGISTER ADVISORY
Benefits of Supplemental Registration
(1) Use of the registration symbol ® with the registered mark in connection with the designated goods, which provides public notice of the registration and potentially deters third parties from using confusingly similar marks.
(2) Inclusion of the registered mark in the USPTO’s database of registered and pending marks, which will (a) make it easier for third parties to find it in trademark search reports, (b) provide public notice of the registration, and thus (c) potentially deter third parties from using confusingly similar marks.
(3) Use of the registration by a USPTO trademark examining attorney as a bar to registering confusingly similar marks in applications filed by third parties.
(4) Use of the registration as a basis to bring suit for trademark infringement in federal court, which, although more costly than state court, means judges with more trademark experience, often faster adjudications, and the opportunity to seek an injunction, actual damages, and attorneys’ fees and costs.
(5) Use of the registration as a filing basis for a trademark application for registration in certain foreign countries, in accordance with international treaties.
See 15 U.S.C. §§1052(d), 1091, 1094; J. Thomas McCarthy, McCarthy on Trademarks & Unfair Competition §§19:33, 19:37 (rev. 4th ed. Supp. 2017).
IDENTIFICATION OF GOODS REQUIREMENT
This feature or characteristic is considered desirable for applicant’s goods because it is one of the hottest peppers on the Scoville Scale. However, if some or all of the goods do not in fact have or exhibit this feature or characteristic, then registration may be refused because the mark consists of or includes deceptive matter in relation to the identified goods. See 15 U.S.C. §1052(a); In re Budge Mfg. Co., 857 F.2d 773, 8 USPQ2d 1259 (Fed. Cir. 1988); TMEP §1203.02-.02(b).
To avoid such refusal, applicant may amend the identification to specify that the goods possess this relevant feature or characteristic. See TMEP §§1203.02(e)(ii), (f)(i), 1402.05 et seq. However, merely amending the identification to exclude goods with the named feature or characteristic will not avoid a deceptiveness refusal. TMEP §1203.02(f)(i).
Therefore, applicant may amend the identification to the following, if accurate (the examining attorney’s suggested changes and additions are in bold font):

REQUIREMENT: REQUEST FOR INFORMATION
(1) Fact sheets, instruction manuals, brochures, advertisements and pertinent screenshots of applicant’s website as it relates to the goods in the application, including any materials using the terms in the applied-for mark. Merely stating that information about the goods is available on applicant’s website is insufficient to make the information of record.;
(2) If these materials are unavailable, applicant should submit similar documentation for goods of the same type, explaining how its own product will differ. If the goods feature new technology and information regarding competing goods is not available, applicant must provide a detailed factual description of the goods. Factual information about the goods must make clear how they operate, salient features, and prospective customers and channels of trade. Conclusory statements will not satisfy this requirement.; and
(3) Applicant must respond to the following questions: Do applicant’s goods contain reaper pepper as an ingredient in the pepper spray? Do applicant’s competitors use the term “REAPER” to advertise similar goods? Who is the typical consumer of applicant’s goods? Where are applicant’s goods typically purchased (provide examples of online and brick-and-mortar store venues)?

Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.
