I am the Trademark Examining Attorney at the U.S. Patent and Trademark Office assigned to the application set forth above.  We had corresponded last month regarding this application (attached).

 

This application has been returned to me for correction.  Some further clarification of the identification of services is required, for definiteness and for proper classification.  I apologize for the inconvenience.

 

In the first clause of the identification, “Consulting services…”, the two elements “home audio systems” and “home video systems” in bold below need to be further clarified, and possibly reclassified.

 

Class 42:          Consulting services in the fields of home automation, home theater design, home audio systems, home video systems, and design of home security systems; Design and development of home automation, home theater systems, home audio systems, home video systems, and home security systems; Custom design of home theater systems, home audio systems, home video systems, and home security systems; Networking of home controls, namely, wireless and wired lighting controls, thermostat and heating controls, home theater controls, and security controls

 

Specifically, what it is about those products that is the focus of the consulting services needs to be clarified.  In other words, what is being consulted on and what expertise is being provided needs to be specified: what is being done to/with the systems?

 

For example, consultation in connection with product design (of those products), or consultation in connection with design (of those products) in the nature of placement and arrangement in a room or home would be in Class 42.  Consultation in connection with installation and repair would be in Class 37.  Consultation in connection with providing consumer product information would be in Class 35. 

 

Please contact me by phone or email to discuss potential amendments.  If we can connect by or before Wednesday July 24, 2019, this issue should be able to be corrected via an Examiner’s Amendment or Priority Action.  Otherwise, I will have to issue an Office Action, and you will have six (6) months to respond.
