Dear Ms. Ferguson:

I am the USPTO Examiner reviewing the above-referenced application.

I have completed my review of the applicant’s response to Office action filed on September 18, 2019.  I am willing to withdraw the likelihood of confusion refusal  with the below proposed amendments to the identification, which further clarify the nature and intended use of applicant’s products.  I note the proposed amendments are consistent with the information provided about applicant’s products in the response to Office action.  With your express authorization, I can amend the application and issue an Examiner’s Amendment to resolve these issues informally.

Please respond as soon as is convenient, but not later than noon (EST) on Tuesday, October 15, 2019

Identification of Goods

Applicant might consider amending to:

International Class 009: In-flight entertainment map product for aircraft showing the flight path, namely, interactive touch screen terminals for viewing aircraft flight path; In-flight entertainment navigation, guidance, tracking, marking and mapping product for aircraft, namely, electronic mapping display interfaces and operational software therefor sold as a unit for use in commercial passenger transport and business aircraft, namely, transparent electronic displays for providing consumers information on the path of the aircraft and surrounding areas along the path of the aircraft

If the above is acceptable and with your express authorization (e.g., return email, telephone call), I can amend the application, as noted above, and issue an Examiner’s Amendment.

Although the USPTO will not accept a formal response by e-mail, an applicant may communicate informally by phone or e-mail with the trademark examining attorney to agree to a proposed amendment to the application that will immediately place the application in condition for publication for opposition, issuance of a registration, or suspension.  See 37 C.F.R. §2.62(c); TMEP §707.  All relevant e-mail communications will be placed in the official application record.

If you have any questions, please do not hesitate to contact me.

Sincerely,
