TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. SUMMARY OF ISSUES THAT APPLICANT MUST ADDRESS:
NO CONFLICTING MARKS FOUND
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
However, applicant must respond to the following requirement(s) before registration can be granted.
IDENTIFICATION OF GOODS
Applicant’s goods are identified as “We want to brand all sports related gear and dress suites for both men and women: boys and girls.”
The identification of goods is indefinite and must be clarified because it does not make clear what the goods are. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Further, this wording could identify goods in more than one international class. For example, dress suits in the nature of clothing, namely, shirts, pants, shorts, skirts, dresses and footwear are in International Class 25 and sports gear in the nature of balls for sports, bags specially adapted for sports equipment, baseball bats, football or soccer goals and basketball hoops are in International Class 28.
Applicant may adopt the following identification, if accurate [the examining attorney’s suggestions appear in bold, underlined text]:
Class 25: Dress suites in the nature of clothing, namely, {list specific clothing items, e.g., shirts, pants, shorts, skirts, dresses, footwear}
Class 28: Sports gear, namely, {list specific goods by common commercial or generic name, e.g., balls for sports, bags specially adapted for sports equipment, baseball bats, football or soccer goals, basketball hoops}

MULTIPLE CLASS APPLICATION REQUIREMENTS
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). The application identifies goods that are classified in at least two classes; however, applicant submitted a fee(s) sufficient for only one class. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

DESCRIPTION OF THE MARK
The mark is currently described as follows: “The mark consists of A star set behind arrows pointing Forward.”
The following description is suggested, if accurate: The mark consists of the stylized letters “ST” with five overlapping five-point stars appearing over the left end of the letter “S”, the top portion of the letter “S” extending to the right to form the top portion of the letter “T”, and ending in a right-pointing arrow. A shorter right-pointing arrow extends out from the middle of the letter “T”.
GUIDELINES FOR RESPONDING TO THIS OFFICE ACTION
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
