INTRODUCTION

 

This Examiner’s amendment follows applicant’s reply of January 14, 2020, in which applicant amended to the Supplemental Register to obviate the Trademark Act Section 2(e)(2) refusal made final by the final Office action dated November 18, 2019.  Applicant’s prior reply of October 21, 2019 contained an unnecessary disclaimer amendment as to “HIMALAYAN’S”.  The applicant has requested this issue be addressed as outlined below.

 

Application has been amended as shown below.  As agreed to by Mark Johnson on January 15, 2020, the examining attorney has amended the application as shown below. 

 

Applicant has authorized the withdrawal of applicant’s voluntary disclaimer of “HIMALAYAN’S”.  The disclaimer is hereby deleted from the application.  See 15 U.S.C. §1056(a); TMEP §1213.01(c). 

 

Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.
