I have reviewed the above trademark application and the descriptive wording “OPTICAL” must be disclaimed. In addition, the identification of goods and services requires amendment.
1) Disclaimer: The following statement may be adopted:
No claim is made to the exclusive right to use “OPTICAL” apart from the mark as shown.
2) Identification of Goods and Services: The indefinite wording “including” must be amended to identify the particular goods in Class 009. In addition, the wording “spectacle glasses” and “optical glass” is indefinite and requires amendment. The wording “Retail store and online optical services” in Class 035 is indefinite and requires amendment. The following may be adopted, if accurate:
IC 009: Contact lenses; optical lenses; optical goods,
