TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

Identification of Goods and Services Requires Amendment:

 

The wording of the identification of goods and services in Classes 16 and 41 is indefinite, overly broad and must be clarified.  See TMEP §1402.01.

Class 18:

  • Boxes of leather or imitation leather for packaging and carrying goods, trunks, suitcases, traveling sets comprised of matching luggage, traveling bags, luggage, garment bags for travel, hatboxes not of paper or cardboard, vanity cases not fitted, toiletry cases sold empty, rucksacks, satchels, handbags, beach bags, leather shopping bags, textile shopping bags, sling bags, suit carriers, shoulder bags, waist bags, purses, travel cases, briefcases, briefcase-type portfolios, leather pouches, wallets, change purses, key cases, business card cases, calling card cases, umbrellas, parasols, animal carrier bags

Class 40:

  • The personalization and decoration of products to the order and specification of others, namely, Custom imprinting of {indicate specific items, e.g., clothing} with decorative design.
    • Applicant must identify the type of customization such as “Custom imprinting of {indicate specific items, e.g., clothing} with decorative designs” or “Sculpting of figurines to the order and/or specification of others”

 

 

Applicant may adopt the following identification, if accurate:  (changes made in bold):

Please further note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. Section 2.71(a); TMEP § 1402.06.  Therefore, the applicant may not amend to include any goods and services that are not within the scope of goods and services set forth in the original identification. 

The applicant is encouraged to consult the PTO’s Acceptable ID Manual, which is available on the Patent and Trademark Office’s home page at http://tess2.gov.uspto.report/netahtml/tidm.html.  The Manual includes explanations and notices of classification policy.  The Acceptable Identification of Goods and Services Manual sets out acceptable language for identifying goods and services of various types.  Utilizing identification language from the Manual may enable trademark owners to avoid problems relating to indefiniteness with respect to the goods or services identified in their applications for registration; however, applicants should note that they must assert actual use in commerce or a bona fide intent to use the mark in commerce for the goods or services specified.  TMEP Section 1402.04.

Mark Description Requires Amendment:

 

Applicant must submit a description of the mark, because one was not included in the application.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies all the literal and design elements.  See 37 C.F.R. §2.37; TMEP §§808.01, 808.02, 808.03(b).  In this case, the drawing of the mark is not in standard characters. Specifically, the current wording is omitting “LAS VEGAS MOSCOW MILANO FLORENCE.”

 

The following description is suggested, if accurate:  The mark consists of circle inside of a circle. The wording "LOUIS VUITTON" appears at the top between the inner and outer circle. The wording "TRUNKS & BAGS TOKYO ROME LONDON GENEVA SHANGHAI SAIPAN HONG KONG SYDNEY NEW YORK SAINT - TROPEZ PARIS_101, AVENUE DES CHAMPS - ELYSEES LOS ANGELES BANGKOK HONOLULU NICE MEXICO OSAKA LAS VEGAS MOSCOW MILANO FLORENCE.”
