ARGUMENT(S) | |
In regards to the "merely descriptive" finding: 1. The applicant previously was awarded the trademark for the "pitchnut" logo (serial number 77145728). In response to the 11 attachments: Attachments -1, 2, 3: The game reviewed on Boardgamegeek.com was constructed by the applicant for review on that web site. Pitchnut is not a common game. Applicant has constructed 202 of the games. The forum question cited in attachment 2 hadn't been responded to in five years, which likely indicates the rarity of the product. Attachments - 4, 5: The applicant was in attendance at the Middlebury tournament. Applicant manufactured and provided all the Pitchnut games played at that tournament. Attachments - 6, 7, 8, 9: Indicates the necessity to differentiate Pitchnut from other games, such Crokinole. Attachment ? 10, 11: Indicates the necessity to differentiate Pitchnut from other games, such as Carrom. | |
